BrezyFlow Terms of Service (User Agreement)

Age Requirement (17+)

The Service is intended for users who are at least 17 years old. By using the Service, you represent that you meet this requirement.

1) The Service

BrezyFlow helps you organize and cherish nail design inspirations and manicure history. Features may include:

• Saving nail styles into categorized collections.
• Recording manicure dates and tracking longevity.
• Storing photos of nail designs to build a visual diary.
• Viewing statistics such as how many days a manicure lasts.

2) Account Registration

You may need an account to use certain features. When you create an account, you agree to provide accurate information, keep your credentials confidential, and notify us of unauthorized use. You are responsible for activity under your account.

3) Your Content

3.1 Content you submit

The Service may allow you to store, upload, or submit content such as photos, text, dates, notes, and collection labels ("User Content").

3.2 Ownership and license

You retain ownership of your User Content. You grant BrezyFlow a limited, non-exclusive, worldwide, royalty-free license to host, store, process, and display your User Content solely to provide, maintain, and improve the Service and as otherwise permitted by your settings and these Terms.

3.3 Content rules

• Do not submit User Content that violates law or regulation.
• Do not submit content that infringes intellectual property or privacy rights.
• Do not submit abusive, harassing, hateful, or obscene content.
• Do not submit malware or harmful code.

3.4 Responsibility

You are responsible for your User Content and any consequences of submitting it.

4) Acceptable Use

• Do not use the Service for unlawful, fraudulent, or harmful activities.
• Do not reverse engineer or attempt to extract source code except where prohibited by law.
• Do not interfere with the Service or bypass security/access controls.
• Do not scrape, harvest, or collect data without permission.
• Do not use automated access in a way that harms performance or other users.

5) Optional Automated Processing / AI Features

Some features may offer automated processing of text or images. If you choose to use these features, you authorize us to process your provided content to produce the requested results. You remain in control of whether to upload content or generate results.

6) Privacy

Our processing of personal information is described in our Privacy Policy (provided separately). By using the Service, you acknowledge that you have reviewed it.

7) Intellectual Property

The Service and its software, design, and trademarks are owned by BrezyFlow or its licensors and are protected by law. Except as expressly permitted, you may not copy, modify, distribute, sell, lease, or create derivative works of any part of the Service.

8) Third-Party Services

The Service may interact with third-party services or content. We do not control third parties and are not responsible for their services or content.

9) Termination

We may suspend or terminate access if you violate these Terms or if necessary to protect the Service, users, or third parties. You may stop using the Service at any time.

10) Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" to the maximum extent permitted by law. We disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11) Limitation of Liability

To the maximum extent permitted by law, BrezyFlow will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenue arising out of or related to your use of the Service.

To the maximum extent permitted by law, BrezyFlow’s total liability for all claims related to the Service will not exceed the amount you paid (if any) to use the Service in the 12 months before the event giving rise to the claim.

12) Indemnification

You agree to indemnify and hold harmless BrezyFlow from and against claims and expenses arising out of your User Content, your use of the Service, or your violation of these Terms.

13) Changes to the Service or Terms

We may modify the Service or these Terms from time to time. Continued use after changes become effective means you accept the updated Terms.

14) Governing Law

These Terms are governed by the laws of the jurisdiction where BrezyFlow Team has its principal place of business, without regard to conflict of laws principles.

15) Dispute Resolution and Binding Arbitration

Any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration on an individual basis, except where prohibited by law. You and BrezyFlow waive any right to a jury trial and to participate in class actions, to the extent permitted by law.

16) Apple App Store Additional Terms (iOS)

• These Terms are between you and BrezyFlow, not Apple. Apple is not responsible for the Service or its content.
• BrezyFlow (not Apple) is responsible for maintenance and support for the Service.
• If the Service fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any). Apple will have no other warranty obligation to the maximum extent permitted by law.
• BrezyFlow is responsible for addressing claims relating to the Service, including product liability, legal compliance, and consumer protection claims, to the extent required by law.
• BrezyFlow is responsible for handling third-party intellectual property infringement claims relating to the Service, to the extent required by these Terms.
• Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
